1. Payment and Booking Confirmation
- Payment Methods:
Payments are preferred via PayPal (+5% fee) or in cash. Bank transfers are only available upon prior agreement. - Deposit and Confirmation:
A booking is only considered confirmed once a deposit of 50% is received. Prior to this, no reservations will be made in the calendar, nor will transport or accommodation be booked. - Booking Changes:
Downgrades to a booking option are not possible after the deposit has been paid. Upgrades are possible at any time, depending on my schedule. - VAT and Pricing:
All prices listed in my marketing materials or on my website are exclusive of the mandatory 13% VAT in Costa Rica. Prices are subject to change without notice. Payments can be made in USD or other currencies (such as Colones, Euros, or Quetzals) based on the current exchange rate (please check Google).
2. Accommodation and Meals
- Free Photos with Accommodation:
- Options 1 & 2: When booking these options, I offer accommodation if the location is remote or if requested by the client. Additionally, you will receive 3 free photos.
- Option 3: 2 nights and 6 free photos are included as standard.
- Larger Projects: For larger projects, I offer additional free photos and accommodation depending on the option booked.
- Meals and Accommodation:
- Meals: For remote locations, I rely on support for food and drink or an affordable alternative (e.g., delivery services).
- Accommodation: I expect clean, comfortable accommodation with privacy. If this is not provided, I reserve the right to choose an alternative accommodation. In such cases, the entitlement to free photos will be forfeited, but no additional cost will be charged to the client if the accommodation is within the usual price range (around 70–80 USD/night).
- Flexibility and Planning:
I travel using public transportation or tourist shuttles and plan my routes in advance. Support with transport and accommodation is required for remote locations. - Regions and Travel Destinations:
I regularly travel to Costa Rica (from Puerto Viejo), Bocas del Toro (Panama), Lago Atitlan (Guatemala), and Mexico City. Other destinations are available worldwide upon request.
3. Cancellations and Rescheduling
- Cancellations:
- Cancellations within 48 hours of the deposit will receive a full refund.
- Up to 2 weeks before the photoshoot, accommodation and transport costs (approx. 70–80 USD/night) will be deducted if the shoot was integrated into my travel schedule.
- Cancellations less than 14 days before the appointment will result in the forfeiture of the deposit.
- Rescheduling:
If the photoshoot is rescheduled, non-refundable accommodation and transport costs may be passed on to the client.
Rescheduling may create gaps in my travel schedule, which could incur additional costs for alternative accommodation. - PayPal Refunds:
For refunds through PayPal, the client will cover the transaction fees.
4. Weather Conditions and Rescheduling
- Less-than-Optimal Weather and Sky Editing:
Photoshoots will proceed even in less-than-ideal weather conditions. The sky and lighting can be digitally adjusted when necessary to achieve the best possible results for outdoor shots—at no additional cost to the client. - Bad Weather:
If the weather prevents a safe and high-quality photoshoot, I reserve the right to cancel the photoshoot and reschedule it based on availability.
5. Photo Editing and Delivery
- After the Photoshoot:
- Pre-selection and Editing: The pre-selection of photos will be available within 1-2 days after the photoshoot (longer during busy periods).
- Editing: After selecting the photos, editing will be completed within 1-2 days (longer during busy periods).
- Delivery:
All photos will be provided digitally via a link that is valid for 14 days. An extension can be requested. - Photo Selection Deadline:
Please select your photos within 1 week. Delays in selecting the photos may lead to longer editing times.
6. Usage Rights and Privacy
- Usage Rights:
All photos are copyrighted by Tanja Mikolcic Photography. You are granted a comprehensive license to use the photos to market your brand, but not to alter or distribute them to third parties. - References and Portfolio:
I reserve the right to use the photos for my portfolio and social media, unless the client expressly objects. - Privacy:
All client data is confidential and will not be shared with third parties.
7. Liability and Warranty
- Liability Disclaimer:
I am not liable for weather-related restrictions or technical issues that are beyond my control. - Warranty:
I ensure that photos will be properly taken and edited. If technical issues arise with the photos (e.g., faulty files), I will work to replace or re-edit the affected photos at no cost, provided this is technically feasible.
9. Photoshoot Preparation Checklist
- Property Preparation:
Please ensure the property is prepared according to my “Preparation Checklist” for the photoshoot. If the client or agent is not present, Tanja Mikolcic Photography will photograph the property as-is and assumes no responsibility for clutter or unwanted items in the pictures.
10. Photographic Quality and Corrections
- Photographic Quality:
Tanja Mikolcic Photography will make every effort to ensure that the final images are of high quality and best represent the property. However, occasionally, a client may feel that the images do not meet their expectations. In such cases, Tanja Mikolcic Photography will work closely with the agent/owner to address and correct the problem with the photos. - Post-Processing:
A reasonable amount of post-processing will be done at no additional cost. Everyone has different expectations for their “best photo,” but before hiring Tanja Mikolcic Photography, please review the Instagram portfolio carefully, as no refunds will be issued for clients dissatisfied with the “style” of the photography. “Style” refers to angles, color, and any other visual aspect of the photo.
11. Contractual Binding and Agreement
By hiring Tanja Mikolcic Photography, you agree to the terms of this contract and acknowledge your acceptance of all the above statements and policies.
